TINJAUAN PENYELESAIAN SENGKETA WANPRESTASI OLEH PELAKU USAHA JUAL BELI ONLINE DI MARKETPLACE BLIBLI
This research examines legal protection for consumers and the resolution of disputes due to default in online buying and selling on one of the Blibli e-commerce marketplaces. The method used is normative juridical with an approach based on legislation. Legal protection is carried out preventively and repressively, with the theories used including agreements, legal protection, legal responsibility, and dispute resolution. Consumers have the right to honest information and protection from the defaulting actions of business actors. Dispute resolution is carried out through litigation, non-litigation such as mediation and arbitration, as well as the digital mechanism of Online Dispute Resolution (ODR). Business actors can be held accountable based on negligence or strict liability. Strong regulations and consumer education are key to fairness in digital transactions.
