In submitting a lawsuit from the Public Prosecutor and the decisions from the Panel of Judges regarding narcotics cases, it is important to design a unique method, considering the uniqueness of each case based on a detailed analysis of the type of crime, the defendant's involvement, as well as the seriousness and type of evidence found, and weighing it in a balanced and thorough manner of the specific circumstances of each case. This approach aims to ensure that the lawsuit and the decisions submitted are in accordance with the principles of legal certainty, usefulness, and justice. However, there is often a lack of uniformity in judges' decisions which results in different treatment of defendants in similar cases, for example, it can be seen in the decisions of the Pagar Alam District Court with Number: 123/Pid.Sus/2022/PN.PGA and Number: 15/Pid.Sus /2023/PN.PGA, as well as that of the South Jakarta District Court with Number: 1119/Pid.Sus/2017/PN.JKT SEL. This inconsistency was mainly caused by the fact that the panel of judges responsible did not refer to the Supreme Court Circular Number 4 of 2010 concerning the Transfer of Narcotics Abusers, Abuse Victims, and Addicts to Medical and Social Rehabilitation Facilities, which resulted in non-uniformity in sentencing decisions for similar cases. In determining future sentences for narcotics abusers, judges should prioritize rehabilitation options compared to applying punitive sanctions to narcotics abusers, considering that the majority of them are addicts who require intensive treatment.
