PERANAN NOTARIS DALAM PENYELESAIAN PEMBUKAAN PEMBLOKIRAN SISTEM ADMINISTRASI BADAN HUKUM (SABH) TERHADAP PERSEROAN TERBATAS (PT)

Salah satu upaya pencegahan Tindak Pidana Pencucian Uang (TPPU), korupsi, manipulasi pajak, transaksi narkoba sampai Tindak Pidana Pendanaan Terorisme (TPPT) serta kejahatan keuangan lainnya yang merugikan negara Indonesia maka dikeluarkan Perpres Nomor 13 Tahun 2018 untuk mengakomodir atau sebagai payung hukum dengan langkah awal menginventarisasi dan mentertibkan administrasi pendirian dan perubahan anggaran dasar badan hukum khususnya Perseroan Terbatas terkait kepemilikan modal usaha minimal 25 persen pemilik manfaat, salah satu pencegahan preventif yang dinilai efektif adalah memblokir akun Sistem Administrasi Badan Hukum (SABH) sehingga Perseroan Terbatas terblokir. Sebagian besar kasus Perseroan Terbatas terblokir karena belum melaporkan Pemilik Manfaat kepada Kemenkumham. Permasalahan yang diangkat dalam penelitian adalah bagaimana tahapan atau proses untuk membuka blokir, peranan notaris dalam penyelesaian terblokirnya SABH terhadap PT, dan akibat hukum terblokirnya dalam proses pendaftaran perubahan anggaran dasar dalam SABH. Penelitian ini menggunakan hukum normatif yang berdasarkan peraturan perundang-undangan dengan meneliti bahan pustaka atau sekunder. Diperlukan peranan notaris untuk mensosialisasikan Perpres Nomor 13 Tahun 2018 tersebut dan membantu menyelesaikan dan diberi tanggung jawab terhadap proses pembukaan blokir melalui Administrasi Hukum Umum (AHU) online, akibat hukumnya PT tidak bisa mendaftarkan perubahan anggaran dasar dan mengubah data usaha di OSS tidak terpenuhi. Kata Kunci : Notaris, Pemilik Manfaat, SABH. As one of the preventive efforts for Money Laundering (TPPU), corruption, tax manipulation, narcotics transaction to Terrorism Funding (TPPT) crimes and other financial crimes harming Indonesia, Presidential Regulation Number 13 of 2018 was issued to accommodate or to serve as an umbrella law. The initial phase of the regulation is to register and align the administration of the establishment of and alteration to articles of association for legal entities, specifically Limited Liability Companies, in regard to business capital ownership of minimum 25 percent of the beneficial owners. One of the preventive efforts deemed effective is to block the Administration System for Legal Entities (SABH) in order to block Limited Liability Companies. In most cases, Limited Liabilities are blocked because they have not submitted a report on Beneficial Owners to the Ministry of Law and Human Rights. The problems raised in this study are to find out the stages or processes to unblock the system, to find out the role of notaries in the settlement of the SABH blockage on Limited Liabilities Companies and to find out the legal consequences of such blockage in the registration process of alteration to articles of association in the SABH. This study used normative law with due observance of laws and regulations by means of researching library or secondary materials. The role of notaries is required to disseminate Presidential Regulation Number 13 of 2018 mentioned and to assist to settle and to be authorized for the unblocking process through online General Law Administration (AHU) system. The legal consequences that Limited Liability Companies cannot register the alteration to their articles of association and cannot change their business data in OSS are not met.
