PERAN NOTARIS DALAM PENCEGAHAN SENGKETA WARIS TANAH DI KALANGAN MASYARAKAT KOTA PALEMBANG

Land inheritance disputes remain a recurring issue within the community of Palembang City and have the potential to generate prolonged conflicts, largely due to the lack of public legal understanding regarding the notary's authority to provide legal counseling. This condition highlights the significance of the notary's role as a public official authorized to draw up authentic deeds in ensuring legal certainty and legal protection. This study aims to analyze the role of notaries in preventing land inheritance disputes, as well as their role in facilitating the resolution of such disputes within the community of Palembang City. This research employs a normative legal research method, utilizing statutory, conceptual, and case-based approaches, supported by empirical data obtained through interviews with notaries and judicial officials. The findings indicate that notaries play a preventive role in land inheritance disputes through the drafting of authentic deeds related to inheritance matters and by providing legal counseling to the parties concerning the rights and obligations of heirs. In addition, notaries contribute to dispute resolution efforts by preparing deeds that confer legal legitimacy on the status of heirs and by facilitating deliberations to achieve mutual agreements. However, the effectiveness of the notary's role is influenced by the level of public legal awareness and the honesty of the parties in providing accurate information. Therefore, optimizing the role of notaries is essential as both a preventive and remedial measure to reduce land inheritance disputes within the community of Palembang City.
