ANALISIS KEPATUHAN INDONESIA TERHADAP PERATURAN BANGKOK RULES TENTANG PEMENUHAN HAK NARAPIDANA PEREMPUAN

Human rights are inherent to every individual, including female prisoners who have gender based special needs. The Bangkok Rules serve as an international standard to ensure fair and humane treatment for female prisoners, and Indonesia has adopted these principles despite challenges in their implementation. This study aims to assess the compliance of the Government of the Republic of Indonesia with the Bangkok Rules in fulfilling the rights of female prisoners using Ronald B. Mitchell's Theory of Compliance through three dimensions, namely outputs, outcomes, and impact. The method used is qualitative with an empirical juridical approach through regulatory analysis, field observations, and interviews at the Palembang Class IIA Women's Prison. The results show that in terms of outputs, the Bangkok Rules principles have been adopted in Law No. 22 of 2022 on Corrections and its implementing regulations; in terms of outcomes, there have been institutional changes in the form of the provision of maternity facilities, women's health services, and gender responsive guidance programs; while in terms of impact, policy implementation has had a positive but not yet optimal effect due to constraints such as overcrowding and infrastructure limitations.
