PENEGAKAN HUKUM ATAS KETIDAKPATUHAN PERUSAHAAN DALAM PELAKSANAAN PENDAFTARAN JAMINAN SOSIAL BAGI PEKERJA

This study is entitled "LAW ENFORCEMENT AGAINST CORPORATE NON COMPLIANCE IN THE IMPLEMENTATION OF WORKERS' SOCIAL SECURITY REGISTRATION." Indonesia is a welfare state in which the government plays an active role in various aspects of citizens' lives to ensure social welfare, including the provision of social security protection for workers. This obligation is stipulated in Article 28H paragraph (3) and Article 34 paragraph (2) of the 1945 Constitution of the Republic of Indonesia and is further reinforced by Law Number 13 of 2003 on Manpower and Law Number 6 of 2023 concerning the Stipulation of Government Regulation in Lieu of Law Number 2 of 2022 on Job Creation into Law. Accordingly, the government bears responsibility for fulfilling workers' social security rights. This thesis addresses two main legal issues (1) how law enforcement is carried out against corporate non-compliance in the implementation of workers' social security registration; and (2) the mechanisms available for workers to claim employment social security benefits in the event of occupational accidents. The research employs a normative legal research method, using statutory and case-based approaches. The findings indicate that (1) law enforcement against corporate non-compliance in workers' social security registration is implemented through the imposition of administrative sanctions; and (2) there are established mechanisms that enable workers to claim employment social security benefits when occupational accidents occur.
