KONVERGENSI NILAI PANCASILA DAN PARADIGMA PEMBANGUNAN BERKELANJUTAN DALAM SISTEM PERLINDUNGAN DAN PENGELOLAAN LINGKUNGAN HIDUP

This dissertation is motivated by the disharmony between accelerated economic development and the preservation of environmental functions in Indonesia. The current Environmental Protection and Management (PPLH) legal system is considered to be dominated by a rigid anthropocentric and positivistic paradigm, often failing to capture the moral values and wisdom living within society. This study aims to analyze and reconstruct the philosophical foundation of national environmental law through the convergence of Pancasila values with the sustainable development paradigm. This study employs normative legal research with philosophical, conceptual, and statutory approaches. The findings indicate that Indonesian environmental law requires a paradigm shift from pure anthropocentrism to Responsible Anthropocentrism inspired by Contextual Biocentrism. This concept excavates the ontological roots of local wisdom across the archipelago—such as the philosophy of Mamayu Hayuning Bawana (Javanese), Tri Hita Karana (Balinese), and the practice of Sasi (Moluccas/Papua)—as the moral basis for nature conservation. Specifically, this research formulates the transformation of the Humanity Principle (Second Silas) into the principles of Environmental Justice and Ecological Human Rights, as well as the Democracy Principle (Fourth Silas) with a vision of Ecocracy, where sovereignty belongs not only to humans but also considers ecosystem sustainability. The dissertation concludes that the convergence of Pancasila values and sustainability principles is indispensable for realizing a responsive and just legal system. Its theoretical implications point towards the strengthening of Ecological Jurisprudence, which places cosmological balance as the highest hierarchy in the formation of national legal norms.
