KONKRETISASI ASAS KEPENTINGAN TERBAIK BAGI ANAK DALAM PENANGANAN TINDAK PIDANA KEKERASAN SEKSUAL
This thesis is titled “The Application of the Best Interest of the Child Principle in Handling Criminal Cases of Sexual Violence,” and it discusses the concrete forms of applying the best interest of the child principle in handling criminal cases of sexual violence committed by children against other children. The objectives of this study include an analysis of the implementation of the best interest of the child principle in the handling of criminal cases of sexual violence committed by children as perpetrators of sexual violence, and efforts to ensure justice for children as victims of sexual violence in accordance with the best interest of the child principle. This study employs a normative methodology using a statutory approach and a case approach. The findings indicate that the application of the best interests of the child principle for child perpetrators has been pursued through the provision of legal assistance, identity protection, and the imposition of sanctions that remain educational and rehabilitative. However, the concrete implementation of the best interests of the child principle for child victims has not been fully realized because the fulfillment of the child victim’s rights to recovery, psychological rehabilitation, and guarantees of long-term protection has not been optimally implemented. Therefore, legal policies and the commitment of law enforcement officials must be fully extended to both parties.
