PENERAPAN LAPORAN PENELITIAN KEMASYARAKATAN (LITMAS) DALAM MEMBERIKAN REKOMENDASI PUTUSAN ANAK YANG BERHADAPAN DENGAN HUKUM
The thesis entitled: “The Application of Social Inquiry Reports (LITMAS) in Providing Recommendations for Juvenile Justice Decisions” is based on the background of the application of LITMAS in providing recommendations for decisions concerning children in conflict with the law. Therefore, the legal issues examined in this study concern the application of Community Research Reports (LITMAS) in providing sentencing recommendations to juvenile judges, and whether the validity of Community Research Reports (LITMAS) in providing recommendations to juvenile judges actually limits independent judicial authority. Accordingly, the findings of this study, which employs a normative juridical method with a statutory approach and is supported by legal material collection through interview techniques, indicate that the application of LITMAS in providing recommendations for decisions also regulates the function of LITMAS as a mandatory consideration in decisions involving children in conflict with the law. Consequently, if LITMAS is not considered in such a decision, the decision may be null and void by operation of law. Furthermore, the applicability of LITMAS in providing recommendations to juvenile judges does not, in fact, interfere with the authority of juvenile judges to decide cases independently.
