PENYELESAIAN WANPRESTASI DALAM PERJANJIAN KREDIT USAHA KECIL MENENGAH (STUDI KASUS: PT BANK MANDIRI (PERSERO) Tbk. REGION II/SUMATERA 2)

Arief, Muhammad Febrian - Personal Name;

The thesis entitled Default Settlement Strategy for Micro, Small, and Medium Business (SME) Credit Debtors at PT Bank Mandiri (Persero) Tbk. Region II/Sumatra 2 is motivated by legal problems related to the occurrence of defaults in credit agreements that can cause non-performing loans (NPL) and have the potential to disrupt the stability of banking activities. The problems discussed in this study are: 1. What are the factors that cause the default of SME credit debtors at PT Bank Mandiri (Persero) Tbk. Region II/Sumatra 2? 2. What is the strategy to settle the default of SME credit debtors carried out by PT Bank Mandiri (Persero) Tbk. Region II/Sumatra 2? The type of research used is empirical legal research with a sociological juridical approach. The data source was obtained through interviews with PT Bank Mandiri (Persero) Tbk. Region II/Sumatra 2 as well as a literature study consisting of primary legal materials, secondary legal materials, and tertiary legal materials. The data analysis technique was carried out qualitatively descriptive, while the conclusion drawing technique used the inductive method. The results of this study conclude that: 1. Factors that cause default of SME credit debtors include internal factors such as the debtor's uncooperative character, the use of credit funds that are not in accordance with the designation, and external factors such as a decline in business conditions. 2. The default settlement strategy carried out by PT Bank Mandiri (Persero) Tbk. Region II/Sumatra 2 prioritizes a persuasive approach through credit restructuring such as rescheduling, reconditioning, and restructuring), while settlement through legal channels is carried out as a last step if the debtor does not show good faith in fulfilling his obligations. Keywords: Banking, Credit Restructuring, Default, SME Loans.
