TANGGUNGJAWAB HUKUM PELAKU USAHA TERHADAP KONSUMEN PENGGUNA PRODUK KECANTIKAN YANG DIJUAL SECARA ILEGAL DI PLATFORM E-COMMERCE
The rapid growth of electronic commerce (e-commerce) in Indonesia has significantly increased the volume of transactions involving beauty products. However, this development has also been accompanied by the widespread circulation of illegal beauty products that lack marketing authorization from the National Agency of Drug and Food Control (BPOM), thereby posing potential health and economic risks to consumers. In practice, business actors often neglect their legal obligations and responsibilities regarding the products marketed through e-commerce platforms. This study sims to analyze the legal provisions governing consumer protection against the circulation of illegal beauty products in e-commerce transactions based on the principle of justice, to examine the legal responsibilities and sanctions imposed on business actors, and to evaluate the role of the goverment in supervising the distribution of such products. The résearch employs a normative juridical method using both statutory and case-based approaches. The findings indicate that business actors may be held liable for the circulation of illegal beauty products through civil, administrative, and criminal sanctions in accordance with the applicable laws and regulations. Nevertheless, the implementation of such liability has not been fully effective due to weak regulatory oversight, limited legal awareness among business actors, and constraints in law enforcement mechanisms within e-commerce platforms. Furthermore, the government's supervisory role remains insufficiently effective, highlighting the need for stronger regulatory frameworks and enhanced interagency coordination to ensure optimal legal protection for consumers.
