KEDUDUKAN HUKUM BADAN PENYELENGGARA JAMINAN SOSIAL KESEHATAN DALAM PENAGIHAN TUNGGAKAN IURAN MELALUI NON-LITIGASI (STUDI KASUS APOTEK VICKY FARMA DI KEJAKSAAN NEGERI PAGAR ALAM)
Employers are required to register themselves and their employees in the BPJS Health or BPJS Employment programs. After registering as BPJS participants, there is an obligation to pay monthly premiums. It is this obligation to pay premiums that many employers often fail to comply with for various reasons. To address the issue of premium arrears, BPJS Health has taken steps to seek legal assistance from the Attorney General’s Office to collect payments from employers in arrears. This study aims to analyze the legal standing of BPJS Kesehatan as a creditor in the collection of overdue premiums and to examine the role and legality of the State Attorney in providing non-litigious legal assistance to BPJS Kesehatan in the case of premium arrears by Vicky Farma Pharmacy. This study is a normative legal study using a statutory approach and a case study approach. The primary legal sources used consist of laws and regulations regarding BPJS, the Attorney General’s Office, and out-of-court dispute resolution, while secondary legal sources include books, undergraduate theses, master’s theses, journals, and tertiary legal sources such as websites. The results of this study indicate that the negotiation process failed due to the pharmacy’s lack of good faith. Nevertheless, monitoring continues as part of the JPN’s efforts in its role as a negotiator.
